Please read these Terms carefully. By accessing or using Via Kashmir, you agree to be bound by these Terms of Service. If you do not agree, please do not use our platform.

1. Acceptance of Terms
By creating an account, making a booking, or otherwise using Via Kashmir ("Platform", "Service"), you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. These Terms constitute a legally binding contract between you ("User") and Via Kashmir ("Company", "we", "us").
2. Use of Platform
Via Kashmir is a marketplace that connects travellers with accommodation providers, cab operators, and tour package creators in Jammu & Kashmir. We act as an intermediary — we are not the provider of the accommodation or services booked through our Platform.
- You may use the Platform solely for lawful personal travel booking purposes
- You may not use the Platform to make speculative, false, or fraudulent bookings
- Commercial resale of bookings made through the Platform is strictly prohibited
- You are responsible for ensuring your use complies with all applicable laws
3. User Accounts
- You must provide accurate and complete information when registering
- You are responsible for maintaining the confidentiality of your login credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorised use at contact@viakashmir.com
- We reserve the right to suspend or terminate accounts that violate these Terms
4. Bookings
When you make a booking through Via Kashmir:
- A booking request is sent to the vendor; confirmation is subject to availability
- Upon confirmation, a binding contract is formed between you and the vendor (not Via Kashmir)
- Via Kashmir facilitates the transaction but is not a party to the accommodation contract
- You are responsible for reviewing the property description, amenities, and policies before booking
- Booking IDs serve as your official confirmation reference
Vendors are independent operators. While we verify vendors, Via Kashmir is not liable for the quality, safety, or legality of the services they provide. See our Cancellation Policy for details on modifications and cancellations.
5. Payments
- All prices are displayed in Indian Rupees (INR) inclusive of applicable GST (18%)
- Payments are processed securely by Razorpay; Via Kashmir does not store card details
- A platform service fee may be applied; this is disclosed before payment confirmation
- Vendors receive 85% of the booking total; Via Kashmir retains a 15% platform commission
- Invoices and GST receipts are generated automatically and sent to your registered email
6. Cancellations & Refunds
Cancellation and refund terms vary by property and booking type. Full details are in our Cancellation Policy. Key points:
- Cancellation requests must be made through your Bookings page or our Support Centre
- Refund timelines depend on the payment method (typically 5–7 business days)
- No-shows are treated as cancellations per the vendor's policy
- Disputes related to refunds should be raised within 30 days of check-out
7. Prohibited Conduct
You may not:
- Post false, misleading, or defamatory reviews or content
- Attempt to circumvent or manipulate our payment system
- Scrape, crawl, or extract data from the Platform without written permission
- Impersonate any person or entity
- Engage in any activity that disrupts or interferes with the Platform's operation
- Use the Platform to send unsolicited communications (spam)
- Attempt to gain unauthorised access to any part of the Platform or its infrastructure
8. Intellectual Property
All content on the Platform — including text, graphics, logos, images, and software — is owned by or licensed to Via Kashmir. You may not reproduce, distribute, or create derivative works without our prior written consent. User-generated content (reviews, uploads) remains yours; you grant us a non-exclusive licence to display it on the Platform.
9. Limitation of Liability
To the maximum extent permitted by law, Via Kashmir shall not be liable for:
- The acts or omissions of vendors, including quality, safety, or accuracy of listings
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Force majeure events including natural disasters, government actions, or strikes
Our total liability to you for any claim arising out of these Terms shall not exceed the amount paid by you for the relevant booking.
10. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Srinagar, Jammu & Kashmir. We encourage resolution through our Support Centre before initiating legal proceedings.
